Terms of Service

1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of Addsey ("Service"), operated by Addsey ("we," "our," or "us"). By creating an account or using the Service in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
If you do not agree to these Terms, you must not access or use the Service. We reserve the right to update these Terms at any time. Continued use after changes constitutes acceptance of the revised Terms.
2. Description of Service
Addsey is a software-as-a-service (SaaS) platform that allows registered users to:
- Provision phone numbers, or forward an existing line, to an AI voice agent
- Receive and place voice calls, and send and receive SMS messages
- Configure greetings, skills, flows, escalation, and outbound caller ID
- Fund a prepaid credit wallet and monitor usage via a unified dashboard
Addsey provides communications tooling built on third-party telephony infrastructure. We do not guarantee uninterrupted carrier delivery, and call/message deliverability depends on carriers and recipients' networks.
3. Eligibility
You must be at least 18 years old and legally capable of entering a binding contract to use the Service. You may only use the Service for a lawful business purpose, and it is not available in jurisdictions where such communications or cryptocurrency transactions are prohibited by law.
4. Account Registration
You are responsible for maintaining the confidentiality of your account credentials. You agree to:
- Provide accurate and complete information during registration
- Notify us immediately of any unauthorized use of your account
- Accept responsibility for all activity conducted through your account
We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.
5. Credit Wallet, Funding & Fees
5.1 Funding Your Wallet
The Service is billed from a prepaid credit wallet. You may fund your wallet by card through our payment provider or by sending Bitcoin to the deposit address shown in your dashboard. Bitcoin deposits are subject to review and approval, and are credited at the live BTC/USD market rate at the moment of approval.
5.2 Usage Metering
Voice calls (inbound and outbound) and SMS messages are metered and deducted from your wallet as they occur — voice per second and SMS per message segment. When your balance reaches zero, calls and messages will fail gracefully until you top up. A deposit fee may be applied to Bitcoin funding, disclosed at the time of deposit.
5.3 No Refunds on Bitcoin Deposits
Approved Bitcoin deposits are final and non-refundable due to the irreversible nature of blockchain transactions. Consumed credits (for completed calls or messages) are likewise non-refundable. Card top-ups are subject to the refund terms of our payment provider and applicable law.
6. Acceptable Use & Communications Compliance
6.1 Your Compliance Obligation
You are solely responsible for ensuring your calls and messages comply with all applicable laws in every jurisdiction you contact, including but not limited to the Telephone Consumer Protection Act (TCPA), Do-Not-Call (DNC) rules, call-recording consent laws, and anti-spam regulations. You represent that you have obtained any required consent before contacting a recipient.
6.2 Recording Consent
Where you enable call recording, you are responsible for providing any legally required disclosure to call participants. Addsey offers configurable consent disclosures, but you remain responsible for lawful recording in one-party and two-party consent jurisdictions.
6.3 Caller ID Verification
By default, your outbound caller ID reflects your verified business name. Custom display names require business verification and are individually reviewed and approved before going live. You may not request or use any display name that impersonates a third party or is misleading. We may suspend any approved name pending re-review if it is reported or found to be misleading.
6.4 Carrier & Delivery
Carriers may filter, label, rate-limit, or block traffic (for example as "Spam Likely") based on their own policies and attestation frameworks such as STIR/SHAKEN. Addsey is not liable for carrier-side filtering or for the suspension of numbers by upstream providers.
7. Prohibited Uses
You agree not to use the Service to:
- Place calls or send messages without required consent, or to numbers on applicable DNC lists
- Transmit fraudulent, deceptive, harassing, or unlawful content
- Impersonate another person or entity, including via caller ID
- Promote illegal products, services, or unlicensed financial instruments
- Engage in money laundering, fraud, or other financial crimes
- Attempt to reverse-engineer, scrape, or disrupt the Service
- Use the Service where prohibited by applicable law
Violations may result in immediate account suspension and reporting to relevant authorities.
8. Intellectual Property
All content, branding, software, and features of the Service are the property of Addsey and protected by applicable intellectual property laws. You retain ownership of the content you transmit and the recordings you generate. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose only.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, ADDSEY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING BUT NOT LIMITED TO MISSED CALLS, CARRIER FILTERING OR NUMBER SUSPENSION, LOSS OF DATA, OR CRYPTOCURRENCY PRICE FLUCTUATIONS. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO ADDSEY IN THE 30 DAYS PRECEDING THE CLAIM.
11. Indemnification
You agree to indemnify and hold harmless Addsey and its officers, employees, and agents from any claims, liabilities, damages, or expenses (including legal fees) arising from your use of the Service, the content of your calls or messages, or your violation of these Terms or applicable communications laws.
12. Governing Law
These Terms are governed by applicable law without regard to conflict of law principles. Disputes shall be resolved through binding arbitration or, where not permitted, in the courts of the applicable jurisdiction. You waive the right to participate in any class-action proceeding.
13. Termination
We may suspend or terminate your access at any time, with or without cause. Upon termination, your right to use the Service ceases. Sections 5.3 (No Refunds), 9, 10, 11, and 12 survive termination.
14. Security
Addsey implements industry-standard security controls to protect your account and data:
- Encryption at rest — sensitive tokens and verification documents are encrypted before storage and never logged in plaintext.
- TLS in transit — all communication between your browser, our servers, and provider APIs is encrypted using TLS 1.2 or higher.
- bcrypt password hashing — user passwords are hashed with bcrypt and are never stored or transmitted in plaintext.
- HttpOnly / Secure session cookies — authentication cookies are marked HttpOnly and Secure to prevent client-side script access.
